arizona senator john mccain. mccain is in a tough fight for re-election. the vatican is defending its decision not to defrock a milwaukee priest who had been accused of molesting more than 200 deaf boys over three decades. meantime, in a separate case, "the new york times" is reporting then-cardinal joseph ratzinger, now pope benedict, was told in the 1980s that a pedophile priest in germany would return to pastoral work. the paper says the priest was later convicted of molesting boys in yet another parish. tragedy in arizona where a dump truck hit a group of motorcyclists stopped at a red light thursday killing three of them and injuring six others. in miami, tens of thousands of people turned out thursday in a show of support for cuban dissidents. the march was led by gloria estefan. fire thursday badly damaged the north carolina courthouse where hearings in the john edwards sex tape lawsuit were held. the 19th century building was being renovated when thursday's fire broke out and the tape was

the same sentence but today we'll tell you how you may be able to save money by shedding pounds. jean chatzky is "today's" financial editor, and madelyn is the diet and nutrition editor. good morning to you both. weight loss and taxes. who knew that there was actually maybe a tax benefit. madelyn, tell us first who qualifies for these tax breaks. >> this is great news, because a decade ago the irs said obesity is a chronic illness. if have you a medical and health issue related to their weight, not connected to the number of pounds you have to lose, so the first step is talk to your doctor and see do you have a health issue. this has to be documented, as every other tax writeoff. high blood pressure, diabetes, high blood cholesterol, things like aching knees. if you can document this, it is possible you can have the write-off depending on the plan you use. >> nothing for cosmetics. >> or those last ten pounds. even if you feel better with weight loss, it has to be
medically documented. >> say you do qualify, jean -- or you know somebody who qualifies. what's next? >> you have to pass the tax threshold. this falls under the big um blaf medical expenses. in order for your medical expenses to be deductible in a particular year, you have to exceed 7.5% of your adjusted gross income. >> that's a lot. >> it is a lot. that's why it is difficult for some people to take. if you're going for surgery, and many of your medical expenses may not be covered, add up the numbers and see if you get to the 7.5% threshold. and this year because people's incomes have been down, because there's so much unemployment, people might actually find that it is easier to get there than in previous years. >> we find out through our doctor we may qualify for health reasons, we meet that 7.5% of your income threshold, how do you get around to writing off expenses? what are expenses that qualify under this plan?
>> the irs is firm on this. four big areas. the first is a structured weight loss program. this can be anything from a hospital-based program to weight watchers. both the initial fees and continuing fees to participate. any fda-approved medications. this is something prescribed by your doctor, not online, not anything that's over the counter but fda approved medications. obesity surgery. any type of obesity -- gastric bypass, gastric banding. these are going to be covered. also nutrition counseling or behavioral counseling specifically for weight loss. these are all going to be qualifying. >> but not all weight loss programs. >> but not all weight loss programs. you have to work at this. have documentation you've kept a food record. you don't have to have lost weight but participated. you keep a stress journal, you belong to a group, you're doing things actively showing you are trying to lose weight. >> whenever taxes come up, it's very important to have that paper trail. because in case you get audited, you need to be able to show.
it reminds me of when i got in high school and everybody got a nose job because they had a deviated septum? you have to have a deviated septum. >> there are a lot of options out there geared for weight loss. it is hard to know what will work and what will not. >> if it is doctor prescribed, generally you know that you're in the right area, then you can turn to the irs website which is irs.gov just to double check. i know it says irs and it scares people, but it is a very easy to use website. and if you don't qualify, if it is an over the counter medication, for example, look at the flexible spending program that you're offered through work as a second-tier option. people can put pre-tax dollars into these flexible spending accounts. you can use that money to pay for these, some of these non-qualified items, and save about a third, which is significant. it's not all lost if it's not
deductible. >> don't do things that may not be deductible, gym memberships. >> these are not deductible irs deductions, if it's cosmetic, it's not going to qualify but if it is medically related think about the flexible spending accounts. >> but let's not forget, there is a big savings to just losing weight to begin with. there's such a high cost to obesity, that even to being overweight in terms of the other ways that it affects your overall health. everything from missed days of work to different sorts of medication to -- >> insurance is going to go up. life insurance. >> also the quality of life. don't forget that. it's cost to your life and also out-of-pocket expenses. don't put it off to address this with your doctor and he'll help you document it. >> it is certainly something a lot of us will pay attention to, i'm sure.

your home and you have an unfinished basement, is that something you should consider doing? >> only if you can keep it simple and make it cheap so you freshen it up as usable space but it doesn't pay to put a lot of money there. now up near washington, d.c., this is silver spring, maryland. $449,900 for this four-bedroom home. >> it is just outside washington, d.c. so it is a very popular commuting area. this is in walking distance of art, shopping and good restaurants. this is an old-fashioned brick house but you have to appreciate it is in the best neighborhood of silver spring. >> great neighborhood. >> it looks so small on the outside. i was really surprised to see the inside here but it is basically a great party house. wide open and clean, lots of entertainment space. i think all of the rooms have been painted very pretty colors. this looks like a miniature tiny kid in that corner. the sunroom has been converted from an old porch into a sunroom. very usable, filled with a lot of light. it is probably the most popular room in the house. the backyard i think is the highlight here. has a white fence deck, lower
level paved patio and it is really like being in a parkland. look at that. nice backyard. >> very nice. now our last one, this is a big-ticket item. we normally don't go this high. >> you're getting supporty on me, al. >> nashville, a 3,000 square foot home with four bedrooms. $675,000. i think that's the highest we've ever gone. >> but this is worth spending the money on. put it in its place, nashville, which is a pricey area. in nashville today, it's become like the "in" town. if you stand in line at a local coffee shop of some kind, you might be standing next to a music star or even nicole kidman recently moved there and she talks and talks about how nice it is living there. you don't need a car to live here. in this particular neighborhood, everything's within walking distance. floor plan is wide open. that's a brand-new kitchen. has a lot of old-fashioned details left intact in the house. but it is spik and span new. anybody can just move right in there. i think it is worth the money because all the rooms are large

tax burden on institutions like johns hopkins. but the mayor argues that the city loses $80 million a year. governor o'malley has signed emergency legislation that he argues would create jobs and stimulate the maryland economy. it gives the maryland is this a $5,000 tax credit -- a maryland this is a $5,000 tax credit for our present day -- resident that they hire. the unemployment charges supposed to get fed for money flowing in 45 days. 39 amendments to the state constitutions will be considered by voters in november. one calls for term limits and voter approval of tax increases, another would expand gambling and slots at the airport. leaders believe that many will not pass. let's look to the forecast with john collins.
